TERMS AND CONDITIONS – PRODUCT SAMPLES

1. PREAMBLE

These terms and conditions apply to all purchases of samples on Soerensen Leather’s website. Please read these terms carefully before ordering products from our website.

The Products on our website are intended for Soerensen Leather solely to sell to end users of our products. Any purchase for resale is strictly prohibited, and we reserve the right to take any action against you, including, without limitation, to restrict sales to you, cancel your order or suspend future attempts to purchase samples on our website.

 

2. ORDER AND ORDER CONFIRMATION

When you submit an order on our website, we send you an email acknowledging receipt of your Order (”Order Confirmation”). Our acceptance of your purchase takes place when you receive our Order Confirmation. At this point, the agreement between you and Soerensen Leather is binding.

If we are unable to supply you with the products you ordered, we inform you of this by email as soon as possible and will not process your order. Fulfilment of all orders on our website is subject to availability, and we explicitly reserve the right not to accept your order for any reason. We also reserve the right to cancel an agreement by email without being liable for damages or costs other than repayment of any amount received from you in relation to the agreement, e.g. if the product is not in stock; if we could not deliver to the address provided or if we suspect fraud or resale.

 

3. PAYMENT

We accept the following payment methods: Dankort, VISA/Dankort and Mastercard. We deduct the purchase amount from your account when your order is shipped from our warehouse.

If you pay with a Mastercard Debit, the purchase amount will be reserved on your account (in accordance with the terms of the use of your Mastercard Debit), until we deduct the amount from your account or cancel the payment.

The product prices are inclusive of value added tax (VAT) as applicable. All prices are quoted in the Danish currency (DKK).

The total purchase amount inclusive of VAT and shipping costs is specified in the final checkout screen and in our Order Confirmation.

 

4. SHIPPING AND DELIVERY

We deliver orders to home or business addresses worldwide. You will find information on the specific shipping costs in connection with your order placement.

Under normal circumstances, the delivery time is 1-5 business days in Denmark and up to 10 business days in other countries if the purchased items are in stock. We reserve the right to postpone the estimated time of delivery for any reason.

You receive a shipping confirmation by email when we ship our order from our warehouse.

We provide shipping by GLS, dao and Post Nord. The shipping rates depends on your choice of shipping when you place the order on our website. The shipping rates vary from DKK 100 to DKK 350.

If you have purchased several products, we strive to deliver all products at the same time. We reserve the right to split the delivery, e.g. if part of your order is delayed or unavailable. If we split your order, we notify you by email as soon as possible. You will not be charged any additional delivery costs if we split you order.

 

5. RETURNS AND CANCELLATIONS

You may cancel your order free of charge and without reason until you receive a shipping confirmation notifying you that the purchased items have been shipped from our warehouse. You can cancel your order by using the contact information above.

 

6. RIGHT TO WITHDRAWAL

[This section does not apply to business purchases]

As a consumer you may exercise your statutory right to withdrawal by contacting us within 14 calendar days after the items were delivered to you or to a third party designated by you (other than the carrier).

If you use your right to withdrawal, you must return the products to us without undue delay and no later than 14 days from the day you informed us that you wished to withdraw your purchase.

If the 14-day withdrawal deadline expires on a public holiday, on a Saturday or Sunday, or on 24 or 31 December, the deadline is extended to the first coming weekday.

You must ensure that the products you return are complete and not used in any way. If the returned products are not complete, and the value of the product is diminished as a consequence hereof, we may hold you liable for such diminished value.

Sorensen Leather does not refund your shipping costs related to return of the products when you exercise your right to withdrawal. If you return a purchased product, we reimburse to you all payments received, including the delivery costs without undue delay and in any event not later than 14 days from the day on which you informed us that you wished to withdraw your purchase.

We may, however, choose to withhold reimbursement until receipt of the returned products, or until you have documented that the products have been returned.

7. DEFECTIVE PRODUCTS

Within 24 months after your purchase you are entitled to return products delivered to you if they are defective or otherwise not in conformity with your order at the time of receipt. In the event your claim is justified, the purchase price and shipping costs including your return shipping costs will be refunded.

8. HOW TO RETURN A PRODUCT AND REFUND INFORMATION

If you wish to return a product because you have exercised your right to withdrawal or if the product is defective, you can return the product by shipping the product to our address:

When we receive the returned products or when you have documented return of the products, we refund the purchase price and shipping costs.

If the products are returned because you exercise your right to withdrawal, shipping costs will not be refunded. If the products are returned because of a defect, we return shipping costs. Refunds will be issued based on the original form of payment

 

9. PERSONAL DATA

10. COMPLAINTS

In case you have a complaint, please contact us on the above-mentioned email or by telephone. If you are a consumer, you are entitled to file a complaint to Konkurrence- og Forbrugerstyrelsens Center for Klageløsning, Carl Jacobsens Vej 35, 2500 Valby (www.forbrug.dk) or to the Online Dispute Resolution (ODR) platform which can be accessed through http://ec.europa.eu/odr.

 

11. CHOICE OF LAW AND JURISDICTION

These terms and conditions are governed in all respects by Danish law without regard to choice of law provisions and with the exclusion of the United Nations Convention in Contracts for the International Sale of Goods (CISG).

All disputes, claims and legal proceedings related to these terms and conditions or any purchase according to these terms and conditions shall be resolved exclusively in the competent courts in Denmark.
